1. Introduction

1.1. General information
The following Privacy Policy describes the manner in which Ziemer Ophthalmic Systems AG/Ziemer Ophthalmic Systems Ltd. or Ziemer Ophthalmology (Germany) GmbH (hereinafter Ziemer Ophthalmic Systems) collects, stores and uses information about individuals, particularly customers, healthcare professionals and potential clients who are interested in our products and services.

The term "personal data" used in this Privacy Policy means any information relating to an identified or identifiable natural person (the data subject). An identifiable natural person is someone who can be identified, directly or indirectly, particularly by reference to an identifier such as a name, identification number, location information, online designation, or one or more characteristics of physical, physiological, genetic, mental, economic, cultural or social identity that identify this natural person. In principle, we process personal data as described in this Privacy Policy. However, we reserve the right to additional processing to the extent permitted or required by law or in support of any legal or criminal investigation. Identification of personal information may also be possible in certain circumstances where access to our surgical or diagnostic equipment is required (e.g., immediate repair).

Ziemer Ophthalmic Systems may periodically change, modify, remove, supplement or otherwise update this Privacy Policy without prior notice. However, all personal data is always treated in accordance with the Privacy Policy that was valid at the time the data was collected. Appropriate measures for the protection of personal data are enforced throughout the company and its subsidiaries and sales partners worldwide. Changes to our Privacy Policy will be posted on our websites so that our visitors are fully aware of the types of information collected and used and the circumstances in which that information may be disclosed. 1.2. Server data
By using our websites, you agree to the collection, processing and use of data that your browser transmits to our server. Our website can generally be visited without registration. We collect the following data, which is technically necessary in order for us to display our websites to you and to ensure their stability and security:

  • Quantity of data transferred during the access

The data collected is only used for statistical evaluations and to improve our websites, without this data being directly related to your person. Personal data, in particular name, address or e-mail address, are collected on a voluntary basis. This personal data will not be passed on to third parties without your consent.

1.3. Right of access, correction and objection
Whenever we process personal data, we apply appropriate technical and organizational security measures to ensure that personal data is stored carefully and kept up to date for the purpose for which it was collected. We provide the data subject with the opportunity to inspect the content, correct it and object to the processing of his or her personal data where such processing is not reasonably necessary for a legitimate business purpose or to comply with the law. With our electronic direct marketing, we create the possibility to unsubscribe from further receipt of marketing material. Within the legal framework, the data subject can obtain information at any time as to whether personal data related to him or her are being processed and what their content is; the corresponding information is usually provided within 30 days (Art. 25 Para. 7 Data Protection Act).

When handling personal data, we take the necessary organizational and technical security measures that are suitable to protect this information from loss, misuse, unauthorized access, disclosure, alteration or destruction.

1.5. Privacy Policy for contact form
If you send us inquiries via the contact form, your information from the inquiry form, including the contact details you provided there, will only be stored by us for as long as the purpose of the survey requires it for the purpose of processing the inquiry and in the event of follow-up questions. This personal data will not be passed on to third parties without your consent.

2. Use of Websites

2.1. General terms and conditions
Most of our websites do not require registration, so you can visit the site without giving us any personal information. However, for some services (e.g., the Ziemer E-Learning Center and the download areas for Z-LASIK and Z-Cataract), it may be necessary to provide us with personal data. The decision to withhold personal information we request may mean that you are unable to access certain parts of the site and that we are unable to answer certain questions.

2.2. Confidentiality of personal data and disclosure to third parties
Ziemer Ophthalmic Systems will not sell, share or otherwise make personal data available to third parties, except in the cases provided for in this Privacy Policy. We may share personal data with other subsidiaries of Ziemer Ophthalmic Systems AG who have agreed to treat it in accordance with this Privacy Policy and with the consent of the data subject (see Section 3). Personal data may also be transmitted to third parties acting for us or on our behalf in order to be processed in accordance with the purposes for which the data was originally collected or in another lawful manner, such as the provision of services, the evaluation of the use of this website, marketing, data management or technical customer support. These third parties have contractually committed to us to only use personal data for the agreed purpose and not to sell it to others, not to disclose it to third parties, unless this is required by law, we have permitted it or it is provided for in this Privacy Policy. In addition, your personal data will only be passed on with your consent if there is a legal basis for this, or if this is necessary to enforce our rights, such as the enforcement of claims from a legal relationship. In the event of a sale, merger or other reorganization of all or part of our group of companies, personal data may be sold, transferred or otherwise shared with third parties, to the extent permitted by law.

2.3. Personal information / content regarding healthcare
Ziemer Ophthalmic Systems does not offer medical advice and therefore will not address related issues. We will not knowingly collect, use or disclose personal information from minors (persons under the age of 18) without first obtaining parental consent.

2.4. Cookies, Internet tags, tracking and analysis tools
We may collect and process information about visits to our websites, such as which pages were visited before us and what searches were performed to find our site. We use such information to improve the content of our site and to compile aggregate statistics about which people use our site for internal market research purposes. To enable this, we can install so-called cookies, which record the user's domain name, Internet service, operating system and date and time of access. Cookies are small text files that are sent to the user's browser and stored on their hard drive. Cookies do not damage the computer. Usually the browser reports when a cookie arrives, and the user then has the opportunity to decide whether or not to accept it.

Occasionally we may use Internet tags (also known as action tags, single-pixel GIFs, clear GIFs, invisible GIFs and 1-by-1 GIFs) and cookies on this site and may use these tags/cookies through an advertising partner or web analytics service who is based abroad and stores the relevant information (including the IP address of the user) there. These tags/cookies are placed both on online advertisements that direct users to our sites and on various pages of our website. The advertising partner or web analytics partner may collect data about visitors to our site and other sites because these Internet tags/cookies generate reports for us regarding activity on the site and may provide other services related to the use of the site and of the Internet. 2.5. Web analysis tools
In order to receive anonymous information about the use of our websites and to improve our Internet offer, we use the web analysis tool "Google Analytics". As a result, this data is not only processed by Ziemer Ophthalmic Systems, but also by Google on their behalf. Google will use this information to evaluate your use of the website, to compile reports on website activity and to provide other services related to website and Internet use. Google may also transfer this information to third parties if this is required by law or if third parties process this data on behalf of Google. The IP address transmitted by your browser as part of Google Analytics will not be merged with other Google data (see Google Analytics conditions below). IP anonymization is used on this website. Your IP address will be shortened within the member states of the EU and the European Economic Area. This eliminates the personal reference of your IP address. Only in exceptional cases will the full IP address be sent to a Google server in the USA and shortened there. As part of the agreement on the order data agreement, which the website operators have concluded with Google Inc., Google Inc. uses the information collected to evaluate website usage and website activity and provides services related to Internet usage. The measurements can be anonymous or personal. Cookies, which are stored on your end device, are used for this purpose. 2.6. Use of Google Maps
This website uses the offer of Google Maps. This enables us to show you interactive maps directly on the website and enables you to conveniently use the map function. By visiting the website, Google receives the information that you have accessed the corresponding subpage of our website. This takes place regardless of whether Google provides a user account through which you are logged in or whether there is no user account. If you are logged in to Google, your data will be assigned directly to your account. If you do not wish to be associated with your profile on Google, you must log out before activating the button. Google stores your data as usage profiles and uses them for advertising, market research and/or needs-based design of its website. Such an evaluation is carried out, in particular (even for users who are not logged in), to provide needs-based advertising and to inform other users of the social network about your activities on our website. This Privacy Policy only applies to Ziemer websites and not to third-party websites. We may provide links to third-party websites which we believe may be of interest to our visitors. We strive to ensure that these third-party websites meet the highest standards. However, if you click on such a link, you will leave our website. We are not responsible for the content and data processing of third-party websites and reject any responsibility and liability for this. This Privacy Policy does not apply to linked third-party websites.

2.8. Collection of personal data in online job applications
We offer you the opportunity to apply for employment with us via our website. With these digital applications, your applicant and application data will be electronically collected and handled by us in order to process your application.

If an employment contract is agreed to after the application process, we will store the data you transmitted during the application in your personnel file for the purpose of the usual organizational and administrative process - in compliance with the further legal obligations, of course.

If an application is rejected, we automatically delete the data transmitted to us two months after notification of the rejection. However, the data will not be deleted if the data requires longer storage of up to four months due to legal provisions or until the conclusion of legal proceedings.

If you expressly agree to longer storage of your data, e.g., for your inclusion in an applicant or interested party database, the data will be processed based on your consent.

2.9. Processors
We use external service providers (processors) for web hosting. Separate order data processing has been agreed to with the service provider in order to ensure the protection of your personal data.

3. Processing of personal data collected at exhibitions and events

Ziemer Ophthalmic Systems works closely with congress organizations to protect personal data in accordance with the congress guidelines. Personal data obtained during exhibitions and events (such as wetlab participation, product presentations, symposium visits, and requests for further documentation) are stored in our mailing systems with the purpose of being able to send the relevant persons up-to-date information about our products. Our on-site employees point this out in a personal conversation and ask for approval to forward the relevant personal data to our local sales partner. The recipients can unsubscribe from the delivery of this information at any time at the address below (by e-mail or post) and request the deletion of the stored personal data.
